Legal Question in Family Law in California

Cps wants me to file a false domestic violence; why do I have to?

My neice a few years ago (18 then) has had a crush on my husband began to say crazy things ex: our children were hers etc; when she was no longer aloud around my house she told everyone her and my husband had a sexual relationship for several yrs. My husband denys this. She saw a cousler for a short time then stoped. Now a year later she began seeing another Psyciatrist who hearing this same story reported it to athorities under child molestation. No charges have been made but CPS came and interview all 3 of our children and said that there was no signs of any problems however CPS say that they will be coming on those charges sooner or later and want me to file a restraing order against my husband I asked file based on what they said try domestic violence (we never have had D.V) and I dont wan't to split my family up unless the courts have reason and order him to leave then anything to keep my children why are they suggesting I do this and what if law officials never press charges?

It is probably easier to get an attorney now in order to plan with CPS and any charges that the DA may file. This is too important to deal with over the internet. Good Luck, Pat McCrary
