Legal Question in Family Law in California

Can CPS overlook a signed filed Declaration of Paternity, if a private test comes back not the father? I read a signed DOP means their can be no discussion of paternity, requested testing, etc., Who has the legal right to overturn a filed DOP? I feel my civil rights have been violated. Is there any action I can take?

you can set aside the declaration within 2 years or within one year of discovery of fraud.
