Legal Question in Family Law in California

Credit Damage due to ex-spouse's debt

My husbands xwife took their daughter to the dentist (which is convered by my husband along with her medical and vision). The balance due on her dental has not been paid by his x. we have been receiving threating rude messages from a collection agency stating that they are going to report this on our credit record. We signed nothing and were not even present when this visit was made. Can we be responsible for this debt?

Thank you,

Normally, both parents are responsible for med/dental bills unless marital settlement agreement says something to the contrary. Would need to review all to confirm.

YES he can be liable for the dential treatment of his child. It is not necessary for him to present, to be liable for the dental bill. The court order for support should state the amount which each parent is liable for uninsured dental costs. There may be an exception if she did not use the available dental insurance, she may be liable for the cost. Contact an attorney to review this issue, assuming it is worth the cost of consulting an attorney.
