Legal Question in Family Law in California
Why does CSS want my gross income when I am not the parent of the child?
My husband and his ex are in the middle of modification and child support in California. They initially had an agreement for him to pay for tyhe child's schooling now she wants to bring in Suppot Services. He is asking the court to stop the private schooling and to go along with the calculated support instead. Why is my income being asked do I have to support his child? He has been unemployed since May and I make more than him but I have a mortgage to pay. Why am I being looked at the child is not mine. His ex also wants medical ,the initial divorce decree stated that he provide medical when available through work free or at a reasonable cost.He is currently on my med insur. through my job.Does CA calculate my income and expenses for child support and will I be forced to give med insur. too

Relax. All is well. Run the numbers on a child support calculator. You have no legal duty to support a step-child. The calculators take into account tax basis. A new spouse's income tends to place the support obligor into a higher tax bracket, which actually REDUCES child support most of the time.
The medical insurance request by DCSS is simply the standardized cut and paste they use in every single case without any thought about its applicability whatsoever. The law is basically what you indicate in your question, that we look at which party has health insurance available through his/her employer, and see what's the best scenario. It isn't the abusive sounding language in the DCSS request.
