Legal Question in Family Law in California

current and back child support

child support order is in MA but father who is to pay support in CA; total amt of cs and back support is over $60,000; father is remarried living in california in a home owned by current wife. Child now of legal age can child sue and get $$; due to California community property laws can the money owed come from the value of the home that is owned by current wife?

Your enforcement is through the California courts. However, a $60,000.00 arrearage should be of interest to the courts as criminal non-support. You should discuss this with the appropriate authorities, who may be able to apply the most leverage.

You can go through DOR, and they can target the father's tax refunds. You could initially seek a contempt action in Massachusetts to establish the arrears. You may succeed in getting this to become criminal contempt.

Having achieved this, DOR may pursue this action for you in conjunction with its affiliate in California. Or you can retain a CA attorney to get the father into a California Court.
