Legal Question in Family Law in California

I have a current TRO against my soon-to-be ex. We went to court for a hearing about 2 months ago and his attorney requested an evidentiary hearing. The Judge informed me that when the other party requests a continuance they have to be granted, so he maintained the TRO and continued it until this month. Do I have the option to request a postponement or continuance at this time if I don't feel ready to go to court next week?

You can make the request, but the judge will look for good cause to continue the hearing. You will need a good reason you are requesting a continuance if the other party/attorney objects.

You should contact the attorney for your ex to see if he would grant the request. If he refuses, then you'd better be familiar with the local rules on the proper steps to take to request from the judge a short notice continuance!
