Custodial Interference
I had full physical custody of my 8 yr. old daughter. Last year during his xmas visiting time with our daughter, he did not return her at the agreed time, registered her into school where he lives (over 300 miles away) and then started a court action .All of this was done without my knowledge or permission. Even though I have seen lawyers no one has ever told me this is a penal code violation in calif please help me to have my daughter returned. THE PRESIDENCE IN THIS ( CA.PENAL CODE (SEC 277 THRU 280 ) CLEARLY STATES ; (IT DOES NOT MATTER HOW GOOD THE INTENTIONS MAY HAVE BEEN, THE MEANS DOES NOT JUSTIFY THE CRIME TO GET THERE ) PLEASE HELP!!!!!

Waiting a year to take action has probably reduced your chance of obtaining the return of your child. You need to immediately take a copy of the paper work that was submitted to the court by father to get a court order changing custody. After reviewing the paperwork then you can discuss the procedure that will best suit your circumstances.
