Legal Question in Family Law in California

custodial parent wants further protection of my sons...

im the custodial parent of a 6 and 4 year old. the boys mom had made a bad choice of marrying a domestic violent person who is in a 52 week dm class.he currently has 3 restraining orders on him as well from his two ex wives.our family court order states he is allowed no-contact during her visitation with the boys at all. the judge told her that he weighed the right of them having a relationship with the children and the best interest of the boys, and went on to say her fiance has some hoops to jump through and that she would have to decide between him or the children. i feel that there is more i can do to better protect the boys from him, can i get the da involved as he is awaiting a date for him violateing a restraining order with his ex. he /she had violated our court order recently which caused her time down to 9%. her goal is to change custody which ive had for 1 1/2 years. can i get something more constant, a stable order? i am pro per now, will the d.a. help this concern?

You can always ask the Court to only give the mother monitored visitation to the mother to ensure the children's mental and physical well being!

The district attorney will not assist with the child sharing order. If the mother is complying with the current child sharing order, you generally must show a change of circumstances. If she continues to violate the current order, you can ask the court to give her supervised visitation only. Those are options, not advice. Your situation is much too complex to give definitive answers. Good Luck, Pat McCrary
