custody and abandonment

if my husband has custody of our kids then leves them with me and takes off out of state with no plans on ever comming back, and will not tell us where he is or give a phone number, can I move out of the state the kids and I live in with out getting into trouble?

In addition to Mr. Greene's advice, since you will be in court for the change of custody, add a request to move out of state. Mail the notice to his last known address. If he is not represented by an attorney then use the last address for him in the court file.

No you can't just move. But this is easy, you file an OSC for modification of custody which based upon your presentation of the facts has to be granted and then you move. Slap a child support order on it too.
