Legal Question in Family Law in California

Custody of an adult

My mom has alzhiemers and needs daily help. She is married (4 years). Her husband doesn't tell her to take her meds, bath, change her cloths and their house is very dirty. She wants to live with me and asks me daily if she can. Her husband has let me know he wants her with him. He is not in great physical shape himself. If I try to take her he will forbid me from coming in his house and not let her call me anymore. Do I have any legal right to take her out of that house without his permission?

Re: Custody of an adult

If she is competent to make a decision, she can leave at any time. If she is not competent to make a decision then petition to have a conservator appointed to care for her. Adult protective services may remove her from the home is her condition is dangerous to her.
