Legal Question in Family Law in California

custody

My ex and I agreed I would have pyhiscal custody of our child during the divorce. He has since found out his cancer has returned and would like custody of our child for one year. If I agree to this am I going to lose my rights? Is there a way to file paperwork through the court to ensure I can regain custody after that time, or if he becomes to ill to care for her? Would that be considered abandonment? Please help......

No you would not be giving up your rights. All child custody agreements and orders are modifiable with a change in circumstances. A change in his health, making it more difficult to for him to care for the child would be a change in circumstances. You should be working with an attorney and a counselor for your child, this is going to be a very traumatic and difficult time for the child and you have only one opportunity to help him through the circumstances.
