Im going into a custody battle with my soon to be ex husband he rarely sees his daughter and on the most recent occasion she screamed when he came in because she does not know him he also smokes pot he has a medical marijuana card, and also lives in a home where they party frequently and have lots of alcohol laying around me also has anger management issues that scare me he has broken things punched walls kicked a vehicle and dented it all of witch i have photo proof of what is the likely hood that the court would grant me physical custody and is there a chance that he could get supervised visitations? There are a number of issues noted in your question that would raise serious concerns about your daughters health and well being if she had unsupervised visitation with her father. Be sure to ask the mediator and court for domestic violence and drug assessment intervention as part of your request on developing a suitable and safe parenting plan for your daughter. You can also ask the mediation services through your courts to have a separate mediation session without the father present if there is a history of domestic violence.
