custody in california
nomarried live together one child, split up verable agreement on custody 3 day one place then at moms home.Now wont return child what can she do or what are the laws in CA.

You must file an Paternity action if you are the father. Then you can request a hearing for custody and visitation. Normally, custody is not awarded ex parte, but the court can consider visitation issues.

You can request an ex parte emergency order from the court requiring the mother to return custody to you.
