Legal Question in Family Law in California

I already have a custody case between me and my ex for my children. On Tuesday we had court which the court system granted my ex with 5 day custody and myself with two day. On Tuesday night after court my ex's boyfriend beat up my oldest son. I just picked him up and am concerned if I should go file a clam against her?

Presuming that your ex lives with her boyfriend, then, Yes, I would file for an emergency hearing for full custody. But, I would consult with a local qualified family law specialist to help you with this. Good luck!

You should consult with an attorney about filing what is called an ex parte motion for an emergency hearing to protect your children.
