Legal Question in Family Law in California

Custody change

we are trying to obtain full custody of our step son & we know the mother leaves him with his grandmother and lives with another guy but how to we go about proving this to the court? she is on welfare and us using her mother as a reason not to work. when we go over there she is never home & her closet it full of our step son's clothes and not hers. all other rooms are filled with her sisters and their spouses. this is hard on us becasue since we have been spending more time with him they lowered her support and now she is trying to limit our son's time with us to prove to the judge she needs more money. when she hands him over to us he can't wait to see us but when we go and pick him up from the grandmother he has a fit and we know it's because she is living some where else and doesn't take care of him. how do we go about handling this with the judge?

Re: Custody change

You should take all of your court papers to an attorney who practices in the county where your child custody case is filed and who handles child custody cases. He can review the situation and advise you of your best alternative. Otherwise it is too complex to give competent advice without more information. Good Luck, Pat McCrary

Re: Custody change

I don't know if you have done this or not, but file an OSC for a change of custody. But make sure that if you are going to do this, that you have proof. I would ask for minor's counsel.
