custody of child

my daughter 21 is going to have a baby in Aug - the father is a drug addict and an abuser. We fear so much that he will hurt the baby as he has destroyed so many things that my daughter cherisis - her fathers ashes her car her apt anything that she has worked so hard for-we tried to serve him with a restraing order but he left the county - what rights does she have to gain sole legal custody

She should be reporting his abusive conduct. A police report or better yet his arrest for domestic violence will go a long way toward her receiving sole custody. Also if she does not keep him away from the child CPS may become involved and remove the child from her.
