Custody and Child Support

I have a 12 yr old son who has never seen his father. HIs father does pay cort-ordered child support even tho we were never married. I need to know if I need to go to court to file for legal custody, still keeping the child support, or does receiving child support mean I have full legal custody. I need to know since his dad refuses to sign the passport application for our son.
