Legal Question in Family Law in California

custody

My children's mother was arrested and sentenced to do drug court. 2 months ago she was arrested and served a month.Last week she was arrested and she has to serve another month.And still do her drug program.I have my kids and am changing my son's school.I have an arrest record consisting of drug possession and receiving stolen property and am currently on parole with around six months left on parole.Can i get legal custody of my kids.

As a parent you have custodial rights that are superior to non parents. You would need to be able to maintain a home for the children. So long as you continue to comply with parole conditions and maintain a safe home for the children you will most likely be able to get custody.
