Legal Question in Family Law in California

Custody

What is the Constitutional/State Law, if a parent dies, and the other is responsible/able to care for the child, can you state case law on this, please? Can I get a Writ, to get custody? You may not practice in California, but give me your expertise.

The answer will depend on who you are and your relationship to the child. Family code section 3040 states the order in which custody of a child should be awarded.
