Legal Question in Family Law in California

custody /divorce

If I leave my daughter with my husband during the seperation process, and move somewhere else in the city, due to subjecting my 13 year old daughter to negativity and tension between me an him, considering that leaving her at the house is a sense of normalcy for her well being, is that considered abandonment? Would it be frowned on by courts? would it affect custody of my daughter?

Not necessarily, however, the court may not want to disturb her placement with her father absent compelling changed circumstances. Do not delay in filing and requesting custody, visitation or possession of the family residence. Contact me directly.

It is not abandonment and will not be frowned on by the courts. However, it may affect your later custodial arrangment. I suggest that you get the advice of an attorney before making the move. Good Luck, Pat McCrary
