Legal Question in Family Law in California

custody

I have an existing court order. My ex husband left me while I was pregnant and makes no contact with my daughter. in the court order i have sole physical custody but i gave him joint legal. he never responded ot that or the child support so it went into default. now i'm trying to get a passport and they won't let me because he has joint legal. i have no contact with him and wouldn't know how to contact him. how do i go about reoopening the case so that i can get sole legal? i don't know if he'd fight it or not but he makes no attempt to contact my daughter, won't tell me where he lives or anything and every court thing we've had has went into default because he wouldn't respond. Please help!!!!
