Does a father of a child has legal right to request the child move to his county? We with my ex-husband separated when I was pregnant with and got a divorce 1 year later. I have always been a primary caregiver and had a sole custody for a child, he had visitations. 3 years ago I got a permission to move out of state with my child and moved there for a training. My training program is almost over and my ex-husband requested the court to order to me and my daughter to return back to his county so he can have a joint custody. Currently he has supervised visitations once a months and he didn't come to see his child for over a year. My question: is his request that me and my daughter be ordered to move back to his county legal and can potentially be granted or not? Thank you. This is in Contra Coata County in California.

yes, it's a valid request. there is a chance of it being granted, especially if the distance is keeping him from seeing his child and you have no other purpose of remaining now that training is over.

The court will look at the best interests of the child. Your employment will have some affect of the court. You should respond to the request and appear in court. Retain an attorney to assist you in opposing this request.
