Legal Question in Family Law in California

Custody of Grandchildren

My dsughter and her husband are using drugs, don't work and the kids are suffering. How can I go about getting temporary custody of the children, until such time as they get themselves together? What if one or both of them contest it?

Re: Custody of Grandchildren

You can file a petition for guardianship of the grandchildren, or you could also report the drug use and abuse to CPS. An alternative would be to tell them that they must agree that the grandchildren live with you until they get their lives straightened out or you will report the conditions to CPS. The reality is if you file a petition for guardianship the information will be reported to CPS by the court investigator.
