Legal Question in Family Law in California

custody of grandchildren

I have both of my grandchildren living with me. grandaughter is 5 has lived here since birth.my grand son is almost 3 and we have had him for over a year. Their mom lived here for 2 yrs and hasnt seen her since. When she left here she took my grandson with her but my wife went and got him from her at her request. My son is the father and he is a bum. no job no car no way to support these kids. do i have the right to get custody of these kids? The mom lives in florida we are in california. She has another child with another man. I surely dont want to send my grand kids to a strangers house. We have supported these kids to the fullest. they (the mom and dad) have never supported them. What can i do? Is it possible for the mom to show up one day and take them?

Re: custody of grandchildren

You should file a petition to become the guardian for the children. Check with the local bar association there may be a local organization that will represent the children in preparing the petition and representing them in court. A guardianship will allow you to have custody and control of the children. You would also be entitled to receive child support.
