Legal Question in Family Law in California

custody

My husband (seperated) is getting out of jail next week, sooner than I expedted. I am trying to set a custody hearing to change our current arangement (me 60/him 40) to no over night visits with Dad. But now that he's being released before I get a hearing date, is there any way I can keep him from taking the boys? Thre is no history of violence. Thank you.

Re: custody

You would have to get a temporary order suspending visitation pending the hearing. To get such an order you will need to be able to present evidence that the children will be in danger during the visit.
