Legal Question in Family Law in California

Custody Issues

My ex and I have been to court he lowered child support and threatens to take me back for more custody again. He is abusive towards me emotionally and I am contimplating getting a DV restraining order. How will this effect custody and what happens if he retaliates and gets one on me? I have said some things on the phone to him(not threats) that could make me appear to be unstable out of hurt and anger and he told me he recorded it and is going to keep this recording in case I get ''clever''. (his words) I am so afraid of this man and want to be left alone. He is very wealthy and he uses his money to hurt me regardless if it effects our child She is 4. He also wants more time with her so he can pay less. I now have to move from our lovely home and friends, family because I can not afford to live without his support.

Re: Custody Issues

You need to consult with an experienced attorney. Don't simply run and get a TRO because it could possibly hurt you in the long run. You have to balance this out. If you appear to be interfering with his right to have a relationship with his daughter, the courts could look at you as the bad guy and he could end up with custody.
