Legal Question in Family Law in California

custody jurisdiction enforcement

My ex-husband and I had a custody consent order established in Pennsylvania in Oct. 2000, just before I moved to Maryland and he moved to California. My ex-husband has since been in violation of that order by not allowing my child to spend his summer with me. Pennsylvania courts are no longer willing to enforce an order in which both parties no longer reside in PA, and the order has not been transferred to CA. Which government office(s) in CA will enforce this existing order?

The court now having jurisdiction to modify the PA order is the Superior Court in the county that your ex currently resides. The good news is that you may not need to appear personally in California if you retain an attorney. You are required to mediate the matter, but may do that by telephone. Good Luck, Pat McCrary
