Legal Question in Family Law in California
Custody Modification
I am a full-time father. I have had our three year old son for two years. He
attends preschool fulltime, which I completely pay for. My ex-wife is
seeking to be the primary parent. She constantly bails out of her scheduled
time with our son and has never once even called his school, which he has
been attending for 6 months. She claims, in her motion, that it would be
beneficial if he was with her while she was at home. She stays at home with
her other newborn son. By the way, she tried to kill her uncle and has been
5150d on at least 2 occasions. Do I need to worry about anything? Help!!

Re: Custody Modification
A request to be primary custodial parent, especially by the mother, should never be taken lightly. The fact that your son has been with you full time for two years should give you a distinct advantage. To enhance you position you need to take immediate action to prepare for the court hearing. The assistance of an attorney is immediately needed to help you prepare.
