Legal Question in Family Law in California

Custody

I have an 18 month old son, his father and I were never married. His father is currently awaiting a trial for his 3rd DUI and arrest being under the influence of a controlled substance. He has requested unsupervised visits, which I will not allow, so he's threatened to take me to court. Is there any chance that he would be granted unsupervised visitation or even partial custody given his current legal problems?

I recently handled a case similar to this. The dad was ordered to have supervision until he complied substantially with the order to attend AA classes, etc. It took about 6 months altogether for him to get more visitation, as well as unsupervised.

Many things are possible, but based upon what you have stated it does not appear that unsupervised visits are appropriate for the child. Good Luck, Pat McCrary
