Custody

I am planning to leave my husband and move from California to Nevada for career reasons. We have a three year old son together and I would like to take him with me. My husband and I will also be divorcing but have not yet filed. What are my chances of gaining at least partial custody of my son both physical and legal?

The chances of gaining custody depend upon a number of different facts, such as who is the primary care taker of your son etc. Unless you can get father to agree in writing that you can move to Nevada you should start the divorce in California and get a court order allowing the move.
