Legal Question in Family Law in California

Custody

My ex plans to move out of the country next month during his month long visitation with our sons. He is refusing to give me address and province to which he'll be moving. Is there anythign I can do to get that info?

Re: Custody

You should really seek out an attorney for a matter like this, since it sounds like your visitation and custody may need to be revised. It will probably have to be an emergency ex parte OSC.

You don't say which country, and that could be a problem if he does not return your sons. Maybe he might have to come to the US to visit his sons, instead of taking them out of the country. What makes me worried is that he seems to be trying to hide something from you. It is better to be a little overly cautious, than to face a struggle getting your children back.

I would recommend at the time of the OSC that something be put in the order that will prevent things like this from happening in the future.

Re: Custody

Is he taking your sons with him? If so, you need to file an OSC to stop him from taking the kids, or at least an OSC asking the court to order him to provide you with the new address.
