Custody reversal

My exboyfriend and I have joint custody of one child. We are in the middle of our seperation which has been not very pleasant, and in the court documents it states that we are not allowed to speak ill about each other to our child. He has been talking about me and using her to get to me by having her call me when I am out with my friends and not at home. I can see how much it is hurting her and confusing her.

Can I sue him for full custody on these grounds and how do I prove anything?

My daughter is suffering because she is confused. I will be putting her into counseling to help her cope.

I appreciate any information that you can give me.

Unless the situation is very serious, the best approach is to take your daughter to counseling and get a report from the counselor. Basically it is best if your daughter's counselor raises the issue of changing visitation and custody.

If the situation is serious, then the counselor should be consulted immediately and asked to evaluate your daughter.

First u get the report from counsellor and then on the basis of that report apply to the court for the change in the custody order.
