Legal Question in Family Law in California

Custody And What Rights Do You Have Taking A Child Out Of The Country

I am a divorced father who has joint custody, Mother moved to Germany and hasnt seen the child for more then 4 days in the last year (prior year only 30 days) she has 3 months in the summer according to the divorce agreement. But Our 11yr old son doesnt want to goto Germany and I dont want him going either what rights do I have to not hender her visit but restrict it to the United States. Other issue is also she is several years behind in child support how can I enforce an order when she lives out of the country and refuses to pay. 2nd question isnt as important as the first one.

YOU MAY WISH TO FILE A MOTION FOR SOLE LEGAL CUSTODY, BUT THE COURT WILL STILL WANT YOU SON TO VISIT AND HAVE SOME RELATIONSHIP WITH HIS MOTHER. UNLESS THE MOTHER WORKS FOR A U.S. COMPANY, YOU WOULD NEED TO CONTACT A GERMAN ATTORNEY ABOUT ENFORCING THE CHILD SUPPORT ORDER. GOOD LUCK, PAT MCCRARY
