Legal Question in Family Law in California

custody and school question

My ex and I have been divorced for just over a year, seperated for 2. Our oldest child will be starting elementary school next year and we can't agree on where he should attend school. (We live 30 minutes apart.) My ex kept the home we were living in before we were divorced and we currently share custody 50/50. No spousal or child support is made by either party. In a few weeks, his girlfriend of a year will be moving in with him, she is moving in from out of state and up until now they have only had a long distance relationship, so obviously this concerns me for the children's sake. The school close to his home is ranked as a 10, as is the school close to my home. However, I have even agreed to move to the next town over, where the schools, elementary through high school are some of the best in the state. And in our MSA, it was stated that the children would go to school in that district IF ''husband moved to that district''. (Originally he was thinking he would move there so that we could all live closer to each other, but he's since changed his mind). I am concerned that because he stayed in the home that we both lived in, that the courts will grant him custody if I take this to court. Any advice?
