Legal Question in Family Law in California

Custody of 16 year old daughter

My husband and I are starting the process of filing for divorce. We are using a do it yourself kit because we don't have anything to fight about and don't even need to go to court. I cheated on him which is why we are divorcing....if he decides to fight for full custody of our 16 year daugher, what are my chances of getting full custody of her instead of him

Re: Custody of 16 year old daughter

Custody is based on the best interests of the child. The unfaithful conduct will be of no interest in this conduct, except to the extent that it may adversely affect the child. The court looks to who provided the most care for the child prior to the separation.

The court will also be interested in your current living conditions.
