Legal Question in Family Law in California
Getting custody after five years of being divorced.
Hello,
I have been divorced since 1994. My ex wife is going through her second divorce and seems to be medicated all the time. She forgets things and lies to cover them up. I am afraid for my child. Not to mention that she is missing out on so much because of her mother. I am since re-married and can supply much more stability and support. How can I gain custody?

You need to file an OSC for change of custody with the court. You will need to show a change of circumstances from the last court order. You should also be prepared to show specific facts that your child is in danger in the current situation.
Although most people can handle themselves very well in family court, you should consult with an attorney prior to doing anything to determine what you need to do, if you need an attorney, and/or the best way to proceed.

It can be done if you are up to the fight and hire an aggressive family law attorney. Start documenting what you feel is not in the best interest of your child while living with your x. Please call me directly at (619) 222-3504.

You need to file an OSC with the court. COntact an attorney so that your declaration and other filing documents are strong enough to win.

Assuming you have joint legal custody, you can file an OSC motion. You should find an attorney as soon as possible to bring this matter before a judge quickly.
