custody/jail
My kids father,has my child and will not return him.he is a registerd sex offender,and has been lying.i want my child .what do i have to do to make sure he goes to jail for kidnap along with who ever owns the house that he has to register at as a offender.he has no paternity rights, and not on birth ceritifacte as father .whats happens if i call the police and the child or father is not there.i dont want him to run and hide,and i never see my child again

You should contact the police department for help. You do not know where he and your child are at this time. If you can locate the child and his father the court may issue a warrant in lieu of a writ of habeas corpus and have the police arrest dad and bring the child before the court. Speed is important in your case as the child may be in danger and this situation exists the less chance the court will feel that there is an emergency.
