This kind of situation is, unfortunately, fairly common. The details of each situation, however, are unique. So even though there is often a good chance there is something that can be done, it is the details that determine what rights and options you might or might not have. The first detail is whether or not your father had a will, and if so what it said. The next detail is whether or not the estate was put into probate with or without a will. If the estate was probated or is in probate, there are then a lot of other details that would have to be reviewed and analyzed. If there has never been a probate, a completely different set of issues and details would be involved. All of which is a long way of saying there's no way to tell you if there is something you can do or not, without going over the details with you. Unless there was a will that specifically excluded you, there is a decent chance that there is something you can do, but what, and how likely it is to be worth while depends on all those details. If you would like to discuss the situation with me, feel free to email me and we can arrange for a free telephone consultation sometime early next week.
