my daughter was born in ireland was a birth abroad. me and the mother have split(we were never married) can i file for custody in california where we reside?

Where a child is born is irrelevant to where custody proceedings are filed between the parents. What is relevant is where the child resides. So if the child resides here in California and has for at least six months, then California is the proper jurisdiction for a custody proceeding.
