Legal Question in Family Law in California
My daughter hasn't seen her Dad now in 3 years, because he's been in and out of prison. He had 6 visits out of a whole year, and would call me at times when it was his visit, and tell me that he wasn't comfortable with seeing her!!! I don't get child support, and never have, and she's almost 8. So I had his visits stopped because he wasn't doing anything!!! In 2006, it may have been 2007, my husband and I had filed papers through a Legal Aid office for her Dad to sign his rights. The day that he was getting out of prison his counselor told me that he refused to sign and told him that he would take care of it when he got out, and still, nothing has been done!!! Since he hasn't seen her for 3 years, and no contact, isn't that considered abandonment??? I don't know what to do right now!!!!
