Legal Question in Family Law in California
My daughter decided she wanted to stay with her dad. Because I was having huge financial problems paying rent electric clothing and just everyday living. So I let her cause she was upset with me since then I have been totally tricked by him and his mother. He took me to court without my knowledge and says he was awarded full custody and I have supervised visits I still have not seen one paper. The catch is he told me this and also told me I have a felony warrant for checks and if I come he will have me arrested. I know the logical thing would be to go turn myself in but I have 3 other children. And 2 under the age of 5 and I have had many arrangements to go and have my children cared for by family but they never show. I only wrote checks to feed my kids and this father quit paying child support 3 years ago. What do I do is this legal. And my daughter is sneaking calling me crying to have me get her. Assuming there is a warrant, it is one of those situations where it can only get worse if you don't deal with this now. If you go in and explain, at least you have a chance of a judge being sympathetic, especially if you have turned yourself in. Otherwise, you could be picked up at any time, not of your choosing, and be in a worse predicament. I would contact the local public defender and ask to speak to an attorney to determine what the best course of action is.
