There is a statutory procedure for obtaining a legal name change of children. The Self-Help Office or Family Law Facilitator at your local family court should be able to guide you through the process.

You have to file a petition for a name change. The petition can be made part of the paternity action, if one is pending. The father has to be served, or else consent to the name change.
