Legal Question in Family Law in California

If my daughter lives with me full time and I pay all the expenses, what are my ex-husband's rights as far as claiming her for income taxes? Court papers say we have 50-50 custody, but since 2009, my daughter has lived with me 100% of the time. Does my ex husband have rights to claim her on his income taxes?

IRS regulations provide that the parent that has custody of the child or 51% or more of the time is entitled to the dependency exemption.
