Legal Question in Family Law in California

If I let my daughter go visit her mother out of state, can she try to keep her since we have not filed for divorce yet and so there are no custody orders?

Yes. However if either of you file within six months, California will still have jurisdiction over the child and could issue an order that she be returned to California, but you would have to file a motion and then enforce it in the other state.
