Legal Question in Family Law in California

My daughter's dad has never helped me with his daughter. All he does is hang out with his friends and drink all day. He was fleeing from the police for two years. He beat and choke his ex-wife nearly killing her. His family knew the whole time he was on the run and never said a word. He was recently arrested. Since I found out I'm trying to stay away from his family. I would like to get full custody of my daughter. Him and his family wants to fight it in court. Would he have a chance?

Yes you would have a chance, especially since he is incarcerated. You should talk to the local self help center in your court house for filing a motion for sole custody of your daughter. You should get copies of his criminal behavior to assist you in the evidence.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
