my daughter's father uses exccesive force as punishment (e.g hits her with her brush on the face) we are not together. he has sole custody & i have visits. if i report it does she go into the state's custody or will she stay with me

If your daughter is being abused you have a duty to report it to the proper authorities, regardless of who would be awarded custody.
