Legal Question in Family Law in California

Daughter's Letter

I am filing pro per for modification of custody orders because my daughter (16) wants to live with me and I don't have physical custody, just joint legal. She wants to write a letter to the court stating her reasons for leaving her father's residence and moving to mine. Would such a letter be an appropriate item to include with my pleadings?

Re: Daughter's Letter

The court generally does not want children to become involved in these cases. Your child's desire can be presented to the court at an appropriate time. When a child is 16 the court will often allow the child live with the parent of their choice.
