Legal Question in Family Law in California

My daughters' terrible father!

Well, I have two girls, ages 3 and 4. I left their father a year ago. A few months after that, I went to family court, and the mediator recommended that we share custody. In the months following that decision, he was less than cordial with me, which I can deal with (it's still better than the treatment I got when we were together!)

In August, he was diagnosed with leukemia, which caught everyone off guard. He became very bitter, about being sick, about being such a burden to everyone ( he lives with his parents ). Long story short, he's more of a prick than ever (sorry, it's the only word that I could find)!

Last night, I was supposed to pick up my girls (court order says Sunday, at 6.p.m. is the pick up time) and he would only give me the oldest! He got into my face, yelled at me, was extremely profane, called me terrible names, etc... in front of the kids. His mother was crying, he told her to shut up, and my kids were pretty upset, too. I took my oldest, jetted home to get the paperwork, and called a peace officer to come out and help me get the baby. They did, and he handed her over. Whew!!

Now, I filed papers and was supposed to serve him. Now, Iwant to change them before mediation. How do I go about doing that? Thanks

Re: My daughters' terrible father!

You should file an OSC requesting a temporary order terminating father's visitation pending further order of the court. He appears to be out of control and could be a danger to your children. Act quickly as the longer you wait the less likely it is that the court will be grant the temporary order terminating visitation pending a court hearing.

You should file for contempt charges against him and get primary custody with supervised visitation for the father. Contact me directly.
