Legal Question in Family Law in California

RE: Same day, different counties. Thanks for the response. I understand why I'd want to file first. I'm asking what happens if we both file on the same day, in two different counties? How is it decided which court takes the case?

One of you will have to file a motion. The court will decide based on its discretion as to which is the most appropriate venue. It will consider first and foremost where children live, if any. After that it is kind of a toss up based on relative convenience to the courts, parties, witnesses, attorneys, etc.
