Legal Question in Family Law in California

Daycare reimbursement

My ex-husband and I share daycare 50% for work. Somedays he is able to stay home and work out of the house. SO therefore, he wants to pay his daycare directly so he pay less. This means he would be paying a lot less than me. My understanding is that the law says we share 50% because we benefit from each other working. What does the law say?

Re: Daycare reimbursement

The judge has jurisdiction to divide child care as he sees fair, however, in the vast majority of cases that I have seen it is simply 50% of the costs incurred, regardless of who incurs the cost. Therefore, your view appears to be correct, however, only a review of the order can give you a definitive answer. Good Luck, Pat McCrary
